Delhi Court takes note of the fact that no reason for arrest of the AAP MLA has been mentioned in the arrest memo by the investigating officer

Truth and Justice prevailed over BJP’s bigotry today as a Delhi Court granted bail to AAP MLA Amantullah Khan. The Court heavily rebuked Delhi Police for their unjustified action. It is noteworthy that MLA Amantullah Khan was maliciously arrested by the Delhi Police at the behest of BJP yesterday. The Court took note of the fact that no reason for the arrest of the AAP MLA had been mentioned in the arrest memo by the IO.
AAP MLA Amantullah Khan was granted bail by Saket Court of Delhi today. A bail application was filed in the court after the AAP MLA was suspiciously detained and arrested by the Delhi Police. Senior Advocate Ramesh Gupta represented the AAP MLA in the Court with a team of lawyers and submitted that the Delhi Police had arrested the MLA despite him having not done anything illegal. The Court took serious note of the matter and pulled up the Delhi Police for its inadequacies and granted bail to the MLA.
Senior Advocate Ramesh Gupta submitted in the Saket Court that AAP MLA Amanatullah Khan is an innocent person and a public servant and has nothing to do with the alleged offence. He further submitted, “the MLA has not done anything illegal as he is a representative of people and was there to lodge his protest peacefully without any arms. The custody of Amantullah Khan is not required anymore in the present case and no useful purpose would be served by keeping him behind the bars.”
Rapping the Delhi Police for their unjustified action, the Delhi Court noted that it is a settled principle of law that bail is the rule and jail is the exception and perusal of the file reveals that no reason for arrest of the AAP MLA has been mentioned in the arrest memo by the IO. “It is a fact that the MLA was not carrying weapons or arms. Amanatullah Khan is an elected public representative and being an MLA, it is expected from him that he will make efforts to maintain the law and order. Also, there are negligible chances of him absconding, if he is released on bail. The fact that he is no more required for custodial interrogation, and considering submission made on behalf of him and above stated facts and circumstances, application moved by the IO for judicial custody of the MLA is hereby rejected and Amantullah Khan is granted bail,” the Court further noted.
